1 ORGANIZING AUTHORITY

The Organizing Authority (OA) is the Farr 40 Class Association in conjunction with The Storm Trysail Club (STC).

2 HEADQUARTERS

The Event Headquarters will be the Miami Beach Marina, 300 Alton Road, Miami Beach, FL 33139

3 RULES

3.1 This regatta will be governed by the rules as defined in The 2009-2012 Racing Rules of Sailing (RRS).

3.2 If there is a conflict between the NOR and the SI, the SI shall prevail. Neither the NOR nor the SI shall change nor alter any Class Rules. This changes RRS 63.7.

3.3 Yachts shall comply with the 2010 - 2011 ISAF Offshore Special Regulations, Category 4 (except that neither 5.01.1 nor 4.26.4 (g) shall apply for this event) and Appendix 3 of the Farr 40 Class Rules. In the event of conflict, designer and manufacturers original standards shall prevail.

3.4 RRS 30.2, Z Flag Rule, will be changed to replace the 20% scoring penalty with a 10% penalty.

3.5 A boat may take a One-Turn Penalty when she may have broken a rule of Part 2, Rule 31 or Rule 42 while racing. However, if a boat may have broken a rule of Part 2 within the zone of a rounding mark or finishing mark, the penalty that may be taken is a Two-Turns Penalty. This changes RRS 44.1.

3.6 When leaving the dock, boats shall carry a minimum of 1.5 liters of drinkable liquid up to a maximum of 4 liters, per person per day. This liquid is included in the restrictions for moveable ballast in RRS 51, except when being consumed by a crew member.

3.8 Video data and /or photographs taken from any source shall not be used as evidence at protest hearing. This changes RRS 63.6.

4 ELIGIBITIY - The regatta is open to all Farr 40 Class yachts as defined by the Class Rules. Owners, Charterers and Substitute helmsmen shall be current members of the Farr 40 Class Association and approved by the Farr 40 Class Eligibility Review Committee.

5 ENTRY AND REGISTRATION

5.1 Eligible boats may enter using the form online at www.farr40.org

5.2 The entry form and entry fee of $1,750 US shall be submitted to Stagg Yachts no later than February 17, 2012. Late entries may be accepted however an additional fee of $100 US will be due for entries received after that date.

5.3 Crew lists and ISAF Sailor User IDs for all crew, along with designation of alternate, relief or substitute helmsmen and a copy of a valid 2012 One Design Certificate shall be submitted to Stagg Yachts no later than March 1, 2012.

5.4 Registration shall be completed with the OA as described below. Sail declarations may be made on site during registration. To be entered a competitor shall have completed the following no later than 1700 March 6, 2012.

(a) Registered with the OA, including payment of all fees;
(b) Entry Form and 2012 One Design Certificate on file with the OA;
(c) Owner, Charterer and Substitute Helmsmen Class Membership Dues for 2012 paid and on file with Stagg Yachts
(d) Skipper and crew weigh-in, and liability waivers signed and on file with the OA;
(e) Sail Declaration form on file with the OA;
(f) Crew classification declared and verified on the Crew Declaration form, and on file with the OA;
(h) Owner/Skipper shall be a member of their Member National Authority; and
(i) All owners, tacticians and boat captains shall have signed and submitted to the OA Appendix 10 stating that their boat fully complies with the Class Rules and that they will abide by said Class Rules while racing.

6 SCHEDULE

6.2 The race committee intends to conduct as many races as practicable, not to exceed three (3) races on any day, up to a maximum of 10 races for the series. No Warning Signal will be made after 1530 on the last scheduled day of racing.

6.3 After consultation with a noncompeting Class Representative, the PRO may modify the above program according to prevailing weather conditions and/or other unforeseen circumstances.

7 MEASUREMENT AND INSPECTION

7.1 Inspection will take place on March 5th and 6th. Each yacht shall provide a minimum of 1 person to facilitate inspection.

7.2 Crew will be weighed on the official scales at registration.

7.3 All sails must be buttoned and declared as per Class Rules. Random measurement may be conducted. The Class secretary shall advise on site which, if any sails will be measured.

7.4 Random yacht and equipment inspections may be conducted prior to, between races and after racing each day to check for compliance with Class Rules, the NOR and the 2012 - 2013 ISAF Offshore Special Regulations, Category 4, except as modified by this NOR 3.3

8 EVENT ADVERTISING

8.1 Advertising is permitted, as per Class Rules, in accordance with ISAF Regulation 20.

8.2 Each yacht may be required to display event advertising on their bow, and may be strongly urged to display advertising on the backstay and boom. While not racing all yachts are strongly urged to fly the event flag from the forestay.

9 SAILING INSTRUCTIONS - Sailing Instructions will be available at registration and posted at www.farr40.org no later than 72 hours prior to the first race.

10 COURSES AND RACING AREA - Windward - leeward courses will be sailed in the Atlantic Ocean offshore of South Miami Beach (North of the Miami entrance) or Key Biscayne as determined by the OA and Principal Race Officer.

11 PENALTIES

The penalty, if any, for any infringement of the rules (including the Class Rules and ISAF Offshore Special Regulations, Category 4) other than rules of Part 2 will be at the sole discretion of the Protest Committee in consultation with the Class Representative, and may be other than disqualification. This changes RRS 64.1.

12 SCORING Each yacht's score shall be the sum of all of her race scores with no discard. This changes RRS Appendix A2.

13 PRIZES

13.1 Trophies will also be awarded for first through fourth place overall, the top Corinthian boat and for the top boat each day.

14 DOCKAGE

14.1 All boats shall be docked Miami Beach Marina from 0900 hours March 5 until the end of the event. 14.2 Parking for Support Trailers and Vans must be arranged with Miami Beach Marina in advance.

15 SUPPORT BOATS

15.1 Competitors' attention is drawn to the applicable Class Rules and Interpretations. 15.2 Support and Media boats shall register with the OA. 15.3 Dockage for support boats must be arranged with Miami Beach Marina in advance.

16 HAUL-OUT RESTRICTIONS

Yachts may be hauled out only with the prior written permission of the Protest Committee, and under such terms as they may decide. Normally, the Protest Committee shall grant such permission only if necessary to repair damage. While hauled out, bottoms and foils shall not be sanded, polished, washed or otherwise worked on except as permitted by the Protest Committee in the area of repair. Hulls and appendages may be cleaned in the water.

17 MEDIA AND IMAGE RIGHTS WAIVER

17.1 By entering this regatta, the owner (or charterer) and crew members on competing yachts grant at no cost the absolute right and permission to use their names, voices, images, likenesses, and biographical material, as well as representations of their yacht in any media (including television, print and internet), to the OA, the Farr 40 Management Group, Stagg Yachts, the Farr 40 Executive Committee, STC, and other sponsors.

17.2 The Organizing Authority, the Farr 40 Management Group, Stagg Yachts, the Farr 40 Executive Committee, STC and other sponsors shall not use the names, voices, images, likenesses or biographical material of an owner (charterer) or crew member in a way that constitutes an endorsement of products unless the competitor or crew member is otherwise engaged by main sponsor or affiliated companies to endorse its products or otherwise gives his/her prior written consent to such use.

17.3 Owners (charterers) and crew members shall acknowledge and accept the granting of media rights referred to in this paragraph 17 by signing the Entry Form and the Disclaimer and Acknowledgement of Rights Form provided by the OA.

18 DISCLAIMER

18.1 All those taking part in the race do so at their own risk and responsibility. The owner (charterer) and each crew member:
(a) acknowledges and accepts the risks (including the risk of harm to persons and property and the risks associated with the perils of the sea and the seaworthiness of any boat) associated with participation in this regatta and waives all rights against and releases the Organizing Authority, the Farr 40 Management Group, Stagg Yachts, the Farr 40 Executive Committee, STC, and their respective officers, employees, volunteers and members in respect of any loss of life or injury to persons, or loss of or damage to property, suffered in connection therewith;
(b) acknowledges that participation in this regatta by him or her is on the basis that participation is entirely at his or her risk and responsibility and that the Organizing Authority, the Farr 40 Management Group, Stagg Yachts, the Farr 40 Executive Committee, STC, and their respective officers, employees, volunteers and members are not responsible for any boat or its crew;
(c) acknowledges and agrees that this form is governed by the laws of the United States and that any liability for harm to persons that results from breach of an express or implied warranty that this regatta and all services relating thereto will be conducted or rendered with reasonable care and skill is excluded.

18.2 Specific attention is drawn to RRS Fundamental Rule 4, which states: "The responsibility for a boat's decision to participate in a race or to continue racing is hers alone". All competitors shall acknowledge this by signing the Disclaimer and Acknowledgment of Rights Form provided by the Organizing Authority

19 INSURANCE

19.1 The safety of a boat and her entire management shall be the sole inescapable responsibility of the owner/owners' representative. It is the responsibility of the owner to provide insurance for the yacht covering eventual damage to persons or property.

19.2 The boat is required to hold adequate insurance including third-party insurance of minimum coverage of $1,000,000 US. It is the owner or owners' representative's sole and inescapable responsibility to ensure that the insurance is in place and is adequate prior to participating in this event.
